We acknowledge that RuneScape and its related content are intellectual property of Jagex Ltd. KSTrials operates as a non-commercial fan project under fair use principles for educational and entertainment purposes.
3. Copyright Infringement Policy
If you believe that content on our platform infringes your copyright, you may submit a DMCA takedown notice. We will investigate all valid claims and take appropriate action, which may include removing the infringing content.
Please note: Filing a false DMCA claim is illegal and may result in legal consequences. Only submit a claim if you are the copyright owner or authorized to act on their behalf.
4. Filing a DMCA Takedown Notice
To file a valid DMCA takedown notice, you must include the following information:
Required Information:
- Your contact information: Full name, address, phone number, and email address
- Identification of copyrighted work: Clear description of the copyrighted work you claim has been infringed
- Location of infringing material: Specific URLs or locations where the allegedly infringing content can be found on our platform
- Good faith statement: A statement that you have a good faith belief that the use is not authorized by the copyright owner
- Accuracy statement: A statement that the information in your notice is accurate
- Authority statement: A statement, under penalty of perjury, that you are authorized to act on behalf of the copyright owner
- Physical or electronic signature: Your physical or electronic signature

5. Our Response Process
Upon receiving a valid DMCA takedown notice, we will:
- Review the notice for completeness and validity
- Remove or disable access to the allegedly infringing content
- Notify the user who posted the content about the removal
- Provide the user with a copy of the takedown notice
- Inform the user of their right to file a counter-notification
Response Time: We aim to process valid DMCA notices within 72 hours of receipt.
6. Counter-Notification Process
If you believe your content was removed in error or due to misidentification, you may file a counter-notification. Your counter-notification must include:
- Your contact information (name, address, phone, email)
- Identification of the removed content and its previous location
- A statement under penalty of perjury that you have a good faith belief the content was removed due to mistake or misidentification
- A statement consenting to jurisdiction of federal court in your district
- Your physical or electronic signature
After receiving a valid counter-notification, we will forward it to the original complainant. If they do not file a court action within 10 business days, we may restore the removed content.
7. Repeat Infringer Policy
We maintain a policy of terminating accounts of users who are repeat copyright infringers. Users who receive multiple valid DMCA takedown notices may have their accounts permanently suspended.
Strike System:
- First strike: Warning and content removal
- Second strike: Temporary account suspension
- Third strike: Permanent account termination
8. Fair Use and Safe Harbor
We respect fair use rights and recognize that not all use of copyrighted material constitutes infringement. We consider factors such as:
- Purpose and character of the use (commercial vs. educational)
- Nature of the copyrighted work
- Amount and substantiality of the portion used
- Effect of the use on the market for the original work
KSTrials operates under the safe harbor provisions of the DMCA, which protect platforms that promptly respond to valid takedown notices and have policies for dealing with repeat infringers.
9. User-Generated Content
Users are responsible for ensuring they have the right to post any content on our platform. This includes:
- Screenshots and images
- Text content and posts
- Videos and multimedia content
- Custom artwork or modifications
- Forum signatures and avatars
Users who post infringing content may be subject to account penalties, even if they claim ignorance of copyright law.
10. Jagex and RuneScape Content
Special Notice Regarding RuneScape Content:
KSTrials acknowledges that RuneScape, its graphics, sounds, music, and other content are owned by Jagex Ltd. Our use of this content is based on:
- Fair use for non-commercial, educational, and fan purposes
- Transformative use through gameplay modifications
- Community benefit and preservation of gaming history
- No direct commercial exploitation of Jagex's intellectual property
If Jagex or any authorized representative requests removal of specific content, we will promptly comply with such requests.
11. Limitations and Disclaimers
Please note the following limitations:
- We are not responsible for determining the validity of copyright claims
- We do not provide legal advice regarding copyright issues
- Removal of content does not constitute an admission of infringement
